Terms of Use — meme guys

These Terms of Use ("Terms") are a binding agreement between you ("you", "your" or "User") and Emirhan Özkan ("we", "us", "our", or "Developer") governing your access to and use of the mobile application "meme guys" (the "App"), related websites, services and content. The Developer's company address is not provided. If you do not agree to these Terms, do not access or use the App.
By downloading, installing, accessing or using the App you agree to be bound by these Terms and any policies we incorporate by reference. These Terms apply to users worldwide.
Acceptance and Changes
By using the App you accept and agree to these Terms. We may modify these Terms from time to time. If we make material changes we will provide notice (for example, via the App or email when available). Continued use of the App after changes means you accept the revised Terms.
We recommend regularly checking the Effective Date at the top of these Terms.
Eligibility
The App is not intended for children. You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the App. If you are under the age required by your jurisdiction, do not use the App.
By using the App you represent and warrant that you have legal capacity to enter into a binding agreement and are not barred from using the App under applicable law.
Accounts and Account Security
Some features of the App may require you to create an account or sign in using third‑party authentication (Google Sign-In, Apple Sign-In, Facebook Login, Firebase Auth).
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at memeguys46@gmail.com if you suspect unauthorized access or a breach.
We may suspend or terminate accounts suspected of unauthorized use or violation of these Terms.
User Obligations and Acceptable Use
You agree to use the App only for lawful purposes and in accordance with these Terms.
Prohibited conduct includes, without limitation:
- Violating any applicable law or regulation. - Infringing third‑party rights (intellectual property, privacy, publicity). - Uploading or sharing content that is unlawful, threatening, abusive, harassing, defamatory, obscene, pornographic, sexually explicit (including sexual content involving minors), hateful, or promotes violence, discrimination or illegal activity. - Distributing malware, viruses, or other harmful code. - Attempting to circumvent security, copy‑protective measures, or interfere with the normal operation of the App. - Reverse engineering, decompiling, disassembling, or modifying the App except to the extent permitted by applicable law. - Using the App to send spam, phishing or other unsolicited communications. - Creating multiple accounts to evade suspensions or bans.
We reserve the right, but are not obligated, to investigate and take appropriate action against any violation of these Terms, including removal of content and suspension/termination of accounts.
User‑Generated Content (UGC)
The App may allow users to create, submit, post, share or display text, images, audio, video, memes and other content ("User Content" or "UGC").
You retain ownership of UGC you submit, subject to the license you grant us below.
You represent and warrant that you own or have all necessary rights and permissions to submit UGC and that your UGC does not violate these Terms or any third‑party rights.
Content Guidelines: Do not submit content that is illegal, infringing, sexually explicit (especially involving minors), defamatory, violent, hateful, or otherwise offensive. Do not submit personal data of others without consent.
License Grant: By submitting UGC you grant the Developer a perpetual, worldwide, non‑exclusive, royalty‑free, transferable, sublicensable license to use, reproduce, distribute, modify, adapt, publicly display and perform, and otherwise exploit your UGC (including translating and creating derivative works) in connection with the operation, promotion and improvement of the App and Developer’s business.
Moderation: We may review, moderate, remove or refuse to display UGC for any reason or no reason. We are not responsible for UGC posted by other users.
Notices: If you believe your copyrighted work has been infringed, contact us at memeguys46@gmail.com with sufficient information to permit us to investigate and act in accordance with applicable law. We will respond to notices as required by law (including the U.S. DMCA where applicable).
Intellectual Property
All rights, title and interest in and to the App, the Developer’s content, graphics, logos, trade names, and other features of the App are the Developer’s or its licensors’ exclusive property and are protected by copyright, trademark and other laws.
Except for the rights you are granted in these Terms, no rights are granted to you to use any trademarks, service marks, trade names, logos, domain names, or other distinctive brand features of the Developer.
Third‑Party Services and Integrations
The App integrates with third‑party services, networks, SDKs and technologies, including but not limited to: firebase, google_cloud, firebase_analytics, google_analytics, apple_iap, google_play_billing, revenuecat, google_signin, apple_signin, facebook_login, firebase_auth, admob, facebook_sdk, instagram_sdk, tiktok_sdk, twitter_sdk, crashlytics.
These third parties are independent from the Developer; their terms, privacy policies and practices govern your interactions with them. We are not responsible for third‑party services or for their content or behavior.
By using the App you consent to the collection and use of information by such third parties as described in our Privacy Policy and in those providers’ policies.
Payments, Purchases, Subscriptions and Refunds
Business Model: The App uses a freemium model. Some features are free; others require payment via in‑app purchases, one‑time purchases or subscriptions (recurring fees).
Payment Processors: Payments are processed by third‑party payment providers (Apple In‑App Purchases, Google Play Billing, RevenueCat). Your purchase and billing are subject to the payment provider’s terms and policies in addition to these Terms.
Subscriptions and Auto‑Renewal:
- Subscriptions (where offered) will automatically renew at the end of each subscription period unless you cancel prior to renewal. - Renewal charges will be billed to your App Store/Google Play account or the payment method you selected. - To cancel a subscription you must follow the cancellation procedures in the applicable store: - For iOS (Apple App Store): Manage and cancel subscriptions through your Apple ID account settings. See https://support.apple.com for instructions. - For Android (Google Play): Manage and cancel subscriptions through Google Play settings. See https://support.google.com/googleplay for instructions. - We do not control the exact timing of renewal charges processed by Apple/Google; check your store account for billing details.
Price Changes: We may change prices for subscriptions or other paid features. If a price change affects automatic renewal, we will provide notice in accordance with your platform provider’s rules. Your continued use after the price change constitutes acceptance of the new price.
Refunds:
- Our refund policy allows users to request a refund within 14 days of purchase. Refunds are granted at our discretion and are subject to platform provider policies. - For purchases made through app stores (Apple, Google), you may also be required to request refunds from the store provider in accordance with their refund processes. We will cooperate with those providers as necessary.
Taxes: You are responsible for any taxes (e.g., VAT, sales tax) associated with purchases.
Free Trials and Promotional Offers
Free trials or promotional offers, if provided, are subject to the terms of the offer. If you do not cancel before the trial period ends, your subscription will convert to a paid subscription and auto‑renew in accordance with the above billing terms.
Advertising
The App may display advertisements provided by third‑party ad networks (e.g., AdMob). Advertisers are solely responsible for their ads.
Clickable links in ads may direct you to third‑party sites. We are not responsible for third‑party content or practices.
Privacy
Our Privacy Policy describes how we collect, use, share and protect personal data. By using the App you consent to collection and processing of personal data as described in the Privacy Policy.
If you wish to exercise rights under applicable data protection laws (e.g., GDPR, CCPA), contact memeguys46@gmail.com with your request; we will respond in accordance with applicable law.
Disclaimers; No Warranty
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEVELOPER DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON‑INFRINGEMENT, QUIET ENJOYMENT, AND ARISING FROM COURSE OF DEALING OR USAGE.
WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR‑FREE, SECURE OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, RELIABILITY OR COMPLETENESS OF ANY CONTENT, INCLUDING USER CONTENT.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, so some of the above disclaimers may not apply to you to the extent prohibited by law.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL DEVELOPER, ITS AFFILIATES, LICENSORS OR SERVICE PROVIDERS BE LIABLE FOR:
